1. Agreement and relationship with Apple
This User Agreement and End User License Agreement (“Agreement”) is between you and Jianhui Liu (“Licensor”), not Apple. It governs your licensed use of PassMyPic. It supplements the Apple Standard End User License Agreement and other Apple Media Services terms applicable to your download or purchase. If a provision conflicts with a mandatory Apple term, the Apple term controls to the extent of the conflict.
Apple is not responsible for PassMyPic or its content, except for obligations Apple expressly accepts under its terms or applicable law. Apple and its subsidiaries are third-party beneficiaries of this Agreement and may enforce it against you.
2. License grant
Subject to this Agreement, Licensor grants you a limited, personal, revocable, non-exclusive, non-transferable license to install and use PassMyPic on Apple-branded devices that you own or control, as permitted by Apple’s usage rules and Family Sharing rules. PassMyPic is licensed, not sold. No ownership interest in the App transfers to you.
3. License restrictions
Except where applicable law expressly permits otherwise, you may not:
- copy, modify, translate, reverse engineer, decompile, disassemble, or attempt to derive PassMyPic’s source code;
- rent, lease, lend, sell, sublicense, redistribute, or commercially host the App;
- remove or alter proprietary notices or bypass technical protections;
- use the App to infringe rights, violate law, distribute unlawful material, deceive recipients, or interfere with a device, service, or network; or
- misrepresent a PassMyPic technical check as approval, certification, or acceptance by a third party.
4. Your content and generated results
You retain ownership of images and text you provide. You grant PassMyPic only the device-local access needed to perform operations you request. You represent that you have the necessary rights and permissions to process and submit your content.
You are responsible for reviewing crops, dimensions, file size, format, color, transparency, visual quality, metadata, OCR interpretation, and the recipient’s current requirements. Licensor does not submit files for you and does not guarantee that any recipient will accept a result.
5. Pro entitlement
PassMyPic Pro Lifetime is a non-consumable, one-time App Store purchase. It is not an auto-renewing subscription. Apple controls billing, localized price display, taxes, family-sharing eligibility, purchase history, restoration, and refunds. The entitlement is associated with the purchasing Apple ID under Apple’s rules. Restore Purchases may be used to request an eligible restoration.
6. Devices, network, and third-party services
You are responsible for a compatible Apple device, supported operating system, adequate storage, backups, and any connectivity charges. Core processing is performed on device, but App Store purchasing and restoration, legal pages, and support require internet access.
Apple system frameworks and the App Store are third-party services. Their availability and operation are outside Licensor’s control and are governed by their own terms.
7. Maintenance and support
Licensor, not Apple, is responsible for maintenance and support to the extent required by applicable law. Support is available through the PassMyPic Support page. We may update the App for compatibility, security, product, or legal reasons, but do not guarantee that every device or operating-system version will remain supported indefinitely.
8. Warranty and product claims
To the maximum extent permitted by law, PassMyPic is provided “as is” and “as available.” Licensor disclaims implied warranties of merchantability, fitness for a particular purpose, non-infringement, uninterrupted operation, and acceptance of generated results. Mandatory consumer protections remain unaffected.
If PassMyPic fails to conform to an applicable warranty, you may notify Apple, and Apple may refund the purchase price in accordance with Apple’s terms. To the maximum extent permitted by law, Apple has no other warranty obligation concerning the App. Licensor is responsible for other valid product claims to the extent required by law.
9. Intellectual-property claims
If a third party claims that PassMyPic or your authorized use infringes intellectual-property rights, Licensor—not Apple—is responsible for investigating, defending, settling, or resolving that claim to the extent required by applicable law.
10. Legal and export compliance
You represent that you are not located in a country or region subject to an applicable government embargo and are not listed on an applicable restricted-party list, to the extent Apple’s standard terms require that representation. You must comply with laws applicable to your use of the App and its results.
11. Termination
This Agreement remains effective until terminated. You may terminate it by ceasing use and deleting the App. It terminates automatically if you materially breach it. Upon termination, you must stop using and delete all copies of the App, subject to any rights that cannot legally be terminated.
12. Liability
To the maximum extent permitted by law, Licensor is not liable for indirect, incidental, special, consequential, or punitive losses, including lost data, opportunities, submissions, revenue, or business. Where liability cannot be excluded, aggregate liability is limited to the amount paid for PassMyPic during the twelve months before the event giving rise to the claim, unless applicable law requires a different remedy or limit.
13. Governing law and changes
This Agreement is governed by the laws of the People’s Republic of China, without regard to conflict-of-law principles, while preserving mandatory consumer rights and jurisdiction rules that apply where you live. Subject to those protections, disputes will be submitted to a court with competent jurisdiction at Licensor’s domicile in China.
We may update this Agreement to reflect changes to PassMyPic, Apple’s requirements, or law. The current version and update date will be posted here.
